1. Introduction

This website is operated by Obeliver Drinks Ltd (“Obeliver Drinks Ltd”, “we”, “our” or “us”).
These Terms and Conditions, govern your relationship with Obeliver Drinks Ltd. Please read our Terms and Conditions carefully as they affect your rights and liabilities under the law. By using our website or ordering from our website, you are agreeing to these Terms and Conditions. Please read them carefully as they refer to you (the customer, the account Holder) and your rights and liabilities under the law. Please also print and keep a copy of them for your reference. If you do not agree with any of these Terms and Conditions, please do not register or order from Obeliver Drinks Ltd or use our website.
These Terms and Conditions apply to sales to consumers. You are the customer. You agree to purchase products and services (“Products”) from Obeliver Drinks Ltd subject to these Terms and Conditions which will apply to all transactions with us.

2. Amendments

We reserve the right to change the website and update these Terms and Conditions from time to time and publish the updated version on our website. Please check prior to using our website or placing an order, for changes and that you understand the precise Terms and Conditions applicable. Every effort is made to keep information regarding stock availability on the website up to date. If you do not agree with any of the revised Terms and Conditions please do not order from Obeliver Drinks Ltd or continue to use our website. If you continue to use our website or place subsequent orders then you are agreeing to the new Terms and Conditions.

3. Registration

3.1 To register or shop with Obeliver Drinks Ltd, you must be eighteen years of age or over
3.2 To order from Obeliver Drinks Ltd, you must complete the registration process.
3.3 You must ensure that the details provided by you on registration or thereafter are correct and complete.
3.4 You must inform us of any changes to the information that you provided when registering, by updating your personal details. If you move home, you have the ability to update your address by logging into your account on our website.
3.5 Your email address will be used by us to send you information such as order confirmations and changes to the service. By registering with Obeliver Drinks Ltd, you are agreeing that your email address may be used by us to supply you with such information.
3.6 When you register with us you will be asked to create a unique password. You must keep this password confidential and must not disclose it or share it with anyone. It is your responsibility to keep it secure. You will be responsible for all activities and orders that occur or are submitted under your password. You must contact us immediately if you know or suspect that someone else knows your password.
3.7 We reserve the right to modify or withdraw a password at our discretion. We may ask you to change your password, or suspend/cancel your account with us if we believe that there is or likely to be a breach of security or misuse of our site.
3.8 We reserve the right to decline a new customer registration, suspend or cancel any accepted order or cancel registration at any time at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

4. Pricing

4.1 The price that we charge you for the products you order will be the price quoted by us on the website at the time you confirm your order.
4.2 We will not be liable for any prices quoted on our website as a result of any unintentional technical error.
4.3 When your order is delivered you may return any products and receive a full refund if you consider that the difference between the price charged and the guide price shown on the website is unacceptable.
4.4 Please note that the price of products does not include the delivery charge. If your order is subject to a delivery charge, it will be shown to you as a separate charge on the delivery confirmation page before you confirm your order. Any delivery charge added to your order will dependant on: the value of your order, the date and time of your delivery and your delivery address. For our delivery charges please see the Delivery Policy.
4.5 All pricing information on our website is correct at the time of going online. Obeliver Drinks Ltd reserves the right to change prices and alter or remove any special offers from time to time and as necessary.
4.6 All prices exclude Value Added Tax (VAT). Where applicable, 20% VAT will be added to the prices quoted.

5. Ordering

5.1 On registering, our ordering facility allows you to submit orders for process via our website. Before submitting any order, you will be prompted to review your order and make any relevant changes. By confirming your order, you are stating that you have reviewed your order and are happy for us to accept it. You can also place your order by telephone.
5.2 Once you have placed your order, we will confirm the acceptance of the order by sending you an automated email to your email address. At this point we will supply the products to you in accordance with your order and these Terms and Conditions.
5.3 Orders for large quantities of a product may be subject to availability and will be fulfilled at our discretion. For example, if you were to make an order which would use up all stock or limits availability for other customers, we may only deliver half the requested quantity.
5.4 We will always try to supply you with the full quantity that you have ordered. If you are not satisfied with the quantity you have received we will arrange with you for products to be returned to us. Please note that products must be unopened and in the original packaging.
5.5 Whilst every effort has been made to ensure that all graphical representations and descriptions of products available on our website correspond to the actual products, we are not responsible for any variations from these descriptions.
5.6 You shall be responsible for ensuring the accuracy of the details provided on the order form and will not accept an order unless all details requested on the order form have been entered correctly.

6. Substitutes

6.1 We do our best to ensure that your order is fulfilled. However, Products are occasionally subject to availability and market conditions and we do not always know if products are or will be available at the time of accepting an order.
6.2 If for any reason beyond our reasonable control, we are unable to deliver particular products you have ordered, we will not be liable to you.
6.3 In such circumstances, we will contact you to confirm if you would like a substitute or a refund.
6.4 If we do not offer a substitute, we will refund you the price of the item. If we deliver a substitute, this may affect the price you pay. If you are not happy with the price, you may reject that substitute, and we will refund any amount paid for it.
6.5 We use professional carriers. Nevertheless, you must examine products on arrival before signing for it. We will refund the full purchase price including postage and packing of an item which is delivered in a damaged or faultycondition.
6.6 We reserve the right to refuse to issue a refund/replacement item and to recover the cost of the returns delivery from you in the event that the item is found to have suffered damage after delivery or has been misused or used other than in accordance with the instructions or if the problem is due to normal wear and tear. This does not affect your statutory rights.

7. Payment

7.1 Payment for all products ordered, together with the delivery charge must be made before your order can be delivered to you.
7.2 Payment may be made by debit card or credit card via Worldpay Secure payment page. All card transactions will be handled securely by Worldpay. This means that you do not need to register your credit or debit card details directly with us. The payment cards accepted by us are those listed on the website on the date on which your order is placed.
7.3 Please note that we also accept payments made directly into our bank account. If you wish to pay directly into our account, please select “Bank transfer” as the payment method when paying for your order and follow the instructions thereafter. Please note that you will not receive your order until we have received payment.
7.4 Our liability to you in connection with any order will not exceed the total price charged for the relevant products.
7.5 Please note that we do notaccept cheques or postal orders.
7.6 Please note that all prices are exclusive of Value Added Tax (VAT) (where applicable) at the current rates and are correct at the time of entering the information onto the system.

8. Delivery

8.1 There is no minimum order value on our website. You will be charged a flat delivery charge rate. However, from time to time orders over certain amounts may qualify for reduced delivery charges or free delivery
8.2 We currently offer FREELondondelivery for orders over £100and orders below £100 within 10 miles (from SE25). Standard delivery charge is from£4.99
8.3 Delivery can only be made to the address specified by you when you registered on our website or the delivery address you specify when placing your order.
8.4 If you live within our delivery area, Obeliver Drinks Ltd will deliver directly to you using our own delivery service. Otherwise your order will be delivered by our selected local delivery service provider(s).
8.5 You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions.
8.6 We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether.
8.7 Our delivery policy is that all products must be signed for on delivery by an adult aged 18 years or over.
8.8 If someone other than you receives the order and this person looks under 18, proof of age will be requested. If proof is not available and there is no one of that age at the address when delivery is being made, the order may be retained by the driver.
8.9 If someone other than you signs for the order, we are entitled to assume that person is authorized by you to do so. Orders delivered within the delivery area:
8.10 Delivery times will be agreed with you at the time of placing your order.
8.11 We will deliver your order to the main entrance of the delivery address. At your request, our driver may carry your order into the delivery address, for example, to a particular floor in an apartment block or into your kitchen but only if: 1) the driver has your permission and 2) Our driver believes that it is safe and practical to do as you request. We always reserve the right to deliver only to the main entrance of the delivery address.
8.12 It is your responsibility to ensure that an appropriate person is available at the delivery address at all times during the delivery slot to receive and sign for all products on delivery and to inspect the products. On inspection, you are entitled to refuse some of or all of products before signing for them.
8.13 If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address who is 18 years of age or over to accept your order, the driver will leave notification of attempted delivery and will return the products.
8.14 Whilst we make every effort to deliver your order within the selected delivery slot, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control. In such circumstances we will endeavour to contact you as soon as we can to notify you of delays or to reschedule your delivery time and/or date in case of a cancellation. In any event, our liability to you will be limited to the price of products not delivered and the cost of delivery. Orders delivered outside the delivery area:
8.15 Your order will be delivered between 9:00am – 16:30pm on the nominated day by our selected delivery service provider(s). We will ask for your delivery to be made “before the close of work” which usually means 5:30pm. We are unable to specify or guarantee a delivery time. We will not be able to offer delivery on Sunday or Bank Holiday / Public Holiday.
8.16 Our selected delivery service provider(s) will attempt to deliver your order twice. If after the second time they are unable to deliver it, your order will be returned to us. You will not be refunded for the delivery charges.
8.17 Ownership of the products will pass to you once we have finished delivering your order to you.
8.18 We will not be responsible for any loss or damage caused to the products after the contract has been concluded. Otherwise, our liability to you in connection with any order will not exceed the total price charged for the relevant products.

9. Cancellation

9.1 If you have changed your mind about your order, you have the right to cancel it.
9.2 Unless otherwise stated in your confirmation email, you can call us to cancel your order up until 1pm on the day before delivery or dispatch, Monday to Saturday and we will stop the order process.
9.3 You remain responsible for ensuring that any such cancellation is received by us, in time for the deadline.
9.4 Please note that, if your order has already been dispatched, then you will still be charged for the delivery charges.
9.5 As a consumer, on receiving your products, you may also cancel your order at any time within 7 working days starting from the day after the delivery date.
9.6 Where applicable, the price of the products, as paid by you, will be refunded to you through the payment method you used when you purchased the products. You will not be refunded for any delivery charges.
9.7 In any event, our liability will be limited to the price of the products returned to us. Obeliver Drinks Ltd will not accept any further claims for loss from or in connection with the supply of unsatisfactory products, whether direct, indirect, consequential or otherwise, howsoever arising.

10. Returns

10.1 Customer satisfaction is very important to us and we hope that you will be pleased with your order, but if for whatever reason you are not satisfy with your products, you are entitled to return some or all of products after you have received your order. We are happy to refund or replace products.
10.2 In the event that you wish to return products to Obeliver Drinks Ltd, Please you must inform us by e-mail or telephone. Please note that products must be returned to us unopened and in the original packaging within 7 working days starting from the day after the delivery date.
10.3 Once notified, we will make the appropriate arrangements with you to collect or have you return any products to us.
10.4 Please be aware that we will not be responsible for any postage and packaging charges to return products to us, however, you will not be charged additional postage if you request a replacement or collection. We advise that you obtain a free proof of payment (receipt) when returning products.
10.5 Upon receipt of the returned products, we will promptly make a refund (excluding postage or carriage charges) or arrange for the delivery of replacement products, as directed by you.We will normally refund you using the same payment method that you used to purchase the products. This does not affect your statutory rights.

11. Damaged or Incorrect Products

11.1 You must inspect your order as soon as possible after delivery. In the event that the products delivered to you are damaged, incomplete or incorrect, you must call to notify us immediately but no later than 48 hours after delivery.
11.2 If products are damaged in transit and the damage is apparent on delivery, you should sign the delivery note stating that the products have been damaged and then call to notify us immediately but no later than 48 hours after delivery. If you sign for products in good condition, you will not be able to proceed with a claim.
11.3 You will not be charged for any damaged products, incorrect products or products which you have not received.
11.4 If Obeliver Drinks Ltd has not received any communication from you within 48 hours of delivery, regarding any problems with the products, you are deemed to have received the products in full and with no problems
11.5 In the event that the products delivered to you are damaged or include incorrect products, once notified, we will make the appropriate arrangements with you to collect or have you return any products to us.
11.6 Upon receipt of the returned products, we will examine the products and if the products are damaged, we will promptly make a refund or arrange for the delivery of replacement products, as directed by you.
11.7 Where applicable, the price of the products, as paid by you, will be refunded to you through the payment method you used when you purchased the products
11.8 In any event, our liability will be limited to the price of the products that are damaged, incorrect or incomplete and the cost of delivery. Obeliver Drinks Ltd will not accept any further claims for loss from or in connection with the supply of damaged, incorrect or incomplete products, whether direct, indirect, consequential or otherwise, howsoever arising.

12. Special Offers and Promotions

12.1 From time to time, purchases of products may be subject to special offers. All special offers are subject to availability, while stocks last and in accordance with the instructions detailed as part of the promotion. Those instructions form part of the Terms and Conditions.
12.2 We may change the terms of special offers, or withdraw them altogether, at any time and without prior notice. We will honour at the offer price any order placed by you before an offer ends, or is amended or withdrawn.
12.3Obeliver Drinks Ltd reserves the right to offer in our complete discretion; different customers’ different special offers, promotions and the ability to enter different competitions.

13. Privacy Policy

We respect your privacy and are committed to protecting it. The personal information that you give us is held with care and security. We will only use this information lawfully (in accordance with the Data Protection Act 1998). Please see our Privacy Policy for further details.

14. Warranty and Liability

14.1 We will not be responsible for any breach of these Terms and Conditions as a result of any circumstances beyond our control, any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control.
14.2 Whilst we take every care to deliver your order, we cannot be liable for any indirect or consequential loss or damage or loss of profits arising out of our supply or failure to supply the products to you.
14.3 Our entire liability to you in connection with any order will not exceed the total price charged for the relevant products and delivery charges in that order.
14.4 You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
14.5 Nothing in these Terms and Conditions will restrict our liability to you for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty.
14.6 Nothing in these Terms and Conditions affect any of your statutory rights.

15. General Provisions

15.1 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
15.2 These Terms and Conditions and the documents produced in accordance with it comprise the entire agreement between you and Obveliver Drinks Ltd regarding each order which concludes in a contract.
15.3 These Terms and Conditions are subject to English law and the exclusive jurisdiction of the English courts.
